Title

AN ORDINANCE AMENDING SECTIONS 874.01 AND 874.04 OF CHAPTER 874, “MOBILE FOOD VEHICLES,” OF THE BUSINESS REGULATION CODE REGARDING ICE CREAM SALES TRUCKS.

Executive Summary:  The ordinance would repeal the exemption for ice cream sales trucks included in the original legislation.

Body

Legislative History

Mobile food trucks were first authorized by Ordinance 16-55, adopted April 19, 2016.

Purpose & Explanation

Ice cream sales trucks were inadvertently exempted for the definition of “mobile food truck” in the original mobile food vehicle regulations adopted last April.  The amendment would remove the exemption; therefore, ice cream sales trucks would be mobile food trucks, subject to the same licensing requirements as any other mobile food truck.  They may be able to use public right-of-way if properly authorized.
