Body
Legislative History
Passage of House Bill 9 in 2007 established the requirement for elected government officials to attend certified public records training.
Purpose & Explanation
In accordance with the Ohio Public Records Law, Ohio Revised Code Sections 109.43 and 149.43(E)(1), all elected government officials or their designees must attend a three-hour public records training program during each term of elective office during which the official serves. The training must be developed and certified by the Ohio Attorney General's Office, and presented either by the Ohio Attorney General's Office or an approved entity with which the Attorney General's Office contracts. Compliance with this training provision is routinely reviewed as part of the annual financial audit.

At some time during their current terms, Council members elected to office in 2013 must either attend a certified training session or select a designee, who may represent more than one elected officials, for such training. All Council members re-elected in 2013 have personally attended Sunshine Law Training in previous terms. Council members DeSaussure, Smith, Williams, and Wooldredge have indicated a preference that a designee be appointed to fulfill the requirement for their current terms in office. In addition, Council President DeSaussure has indicated that he will likely attend an upcoming training session.
Timing Considerations
A list of upcoming certified training sessions is available on the Ohio Attorney General's website: http://www.ohioattorneygeneral.gov/Legal/Sunshine-Laws/Sunshine-Law-Training Mr. Sch...
