Legislative History
The Land Development Code at Section 1207.11 requires that development must be served by public water and Section 1040.06 of the Codified Ordinances prohibits water wells where municipal lines are available. With passage of Ordinance No. 15-42 on April 7, 2015, and Ordinance No. 15-120 on August 18, 2015 Council established six-month moratoriums on enforcement of these regulations the latter expiring March 31, 2016.
Purpose & Explanation
Although the situation pertaining to a water service agreement between the Cities of Hudson and Akron has improved and the City of Akron is allowing connections to the public water system, staff believes it is prudent to extend the temporary moratorium until an agreement is executed. The ordinance would ease the burden of persons who wish to construct homes or develop nonresidential projects in the Akron water district who are refused service by removing the need for developers to seek a variance from these requirements from BZBA. Highlights of the ordinance are:
* Connections to public water systems for new development are required unless a written refusal to provide such service to a specific development from the City of Akron is submitted. In the latter situation regulations requiring public water in the Akron water district would be suspended for that development until September 30, 2016. Water wells would be permitted.
