AN ORDINANCE ENACTING A NEW CHAPTER 874, “MOBILE FOOD VEHICLES,” OF THE BUSINESS REGULATION CODE; AND DECLARING AN EMERGENCY.

Executive Summary:  This Ordinance would allow food trucks at special community and private events but would not allow them otherwise.

City Ordinances do not presently permit food trucks.

Purpose & Explanation

Recent trends have shown an explosion in the popularity of food trucks.  Mobile food vehicles (MFV) have become popular in downtown districts, as special events/festivals, and in office and industrial parks. Staff is proposing that Council explicitly permit MFVs at special community and private party events when permitted by the City manager, but not to allow them otherwise at this time.  Key provisions of the legislation are:

1.                     Food trucks would be permitted only at events permitted by the City.

2.                     Insure the safety of MFV employees, customers, and passers-by, and the protection of property.

3.                     Regulations that are easy to comply with and administer.

The legislation is related to special event legislation that is also being proposed separately at this time.

Timing Considerations

Staff requests Council adopt the legislation, so that it can be effective for special events occuring this year.
