Executive Summary: As part of the upcoming "Downtown Railroad Culvert Improvement", the Norfolk Southern Railway Company requires a Construction Agreement with Force Account to be executed prior to any construction. An amendment to the Force Account Estimate is required prior to execution of the Construction Agreement.

Purpose & Explanation
On March 5, 2014, Council authorized the City Manager to enter into a Construction Agreement with Norfolk Southern Railway Company for the "Downtown Railroad Culvert Improvement" project. Part of the agreement included setting up a Force Account in the amount of $51,262.00 to cover Norfolk Southern costs for inspection, travel, administration work, and construction engineering. This fee, based on 2014 rates, was valid for one year. As the previous Force Account Estimate has expired, an updated Force Account with updated hours and rates, in the amount of $53,016.00 (an increase of $1,754.00), is required prior to the Construction Agreement being executed and construction beginning.
Timing Considerations
Once this Resolution is approved, the City Staff will forward a signed Construction Agreement to the Norfolk Southern Railway Company and proceed with the project which is scheduled for construction in the Fall of 2016.
