Title

AN ORDINANCE AMENDING SECTION 1207.17, “SIGNS,” AND CHAPTER 1213, “DEFINITIONS,” OF THE LAND DEVELOPMENT CODE CONCERNING THE APPLICABILITY OF SIGN REGULATIONS AND INTERNAL ILLUMINATION OF SIGNS.

Executive Summary:  These private party initiated amendments have been withdrawn.  They would have removed restrictions on signage, including those that prohibit internal illumination of signs.

Body

Legislative History

The Land Development Code was adopted in December 1999.  Section 1207.17, the Sign Code, and related design standards were extensively amended by Ordinances No. 02-127 and 02-128, adopted September 4, 2002.

Purpose & Explanation

The Community Development Department provided notice of violation concerning the internal illumination of signs to a tenant of Hudson Station.  The property owner and tenant sought to remedy the violation by applying for amendments to the Land Development Code.

Although the proposed ordinance received first reading and was scheduled for a public hearing at Planning Commission, Mr. Dean Hoover, the attorney for the applicant, withdrew the application on May 9, 2016.  Council must act to end further consideration of the Ordinance.

The City has resumed its enforcement action against the illegal signage and has issued its last warning letter before imposing civil infractions.

Timing Considerations

Council should close this case as soon as practicable.

Fiscal Impact

                       Currently Budgeted

                       Supplemental Appropriation Required

  X                       Appropriation Not Required.

Recommendation

Suggested Action

Staff recommends Council approve a motion to the effect that because the proposed Land Development Code text amendment was withdrawn at the request of the applicant, the Ordinance will be removed from further consideration.
