Legislative History

With City Council’s authorization, the City enters into an Agreement with the Summit County Public Defender’s Commission annually for the defense of indigent defendants.

Purpose & Explanation

The City incurs costs for the defense of indigents and is obligated to pay for the services provided, pursuant to Chapter 120 of the Ohio Revised Code and Administrative Code 120-1-09.  For invoices received year to date, 15 cases were billed at a rate of $170 per case, and a total of $2,550 has been paid to the Legal Defenders Office of Summit County in 2016.

The Legal Defenders Office has requested approval of legislation authorizing contract services for the defense of indigents for cases opened during the period from January 1 through December 31, 2017, billable at a rate of $170 per case or up to $750 if a case goes to trial, which reflects no increase over the current rates.

The new agreement is effective January 1 through December 31, 2017.
