Executive Summary:  The service agreement between the Northeast Ohio Regional Sewer District (NEORSD) and the City is required to ensure the consistent and coordinated delivery of the NEORSD Regional Stormwater Management Program services within the City of Hudson.

Purpose & Explanation

The Ohio Revised Code Chapter 6119, ad Title V of the NEORSD’s Stormwater Management Code provides authorization for the sewer district to provide overall Stormwater Management of Regional Stormwater Systems as a governmental entity. The City Solictor has reviewed the Service Agreement.

As part of the Service Agreement, the NEORSD is mandated to operate and maintain the Regional Stormwater System (streams and stormwater infrastructure draining greater than 300 acres) in the Brandywine Creek watershed within the City of Hudson and other member communities.  This management includes planning, financing, design, improvements, construction, inspection, monitoring, maintenance, operation, and regulation for the proper handling of stormwater runoff and the development and provision of technical support information and services.

The Service Agreement also allows the City to access the NEORSD’s Community Cost Share Program which provides funding to member communities for community-specific storm water management projects.  The funds available to the City via the Community Cost Share Program are 25% of the total annual Stormwater Fee collected in each Member Community and are eligible for construction, operation, and maintenance of the City’s local stormwater system. The projected amount available to the City is $110,000/year, based upon a 90% collection rate.

NEORSD recently requested that the City designate a representative and alternate to serve on the Cuyahoga River South Watershed Advisory Committee, and the City Manager has delegated this responsibility to the Engineering Department.

Timing Considerations

If approved by Hudson City Council, the City Manager will enter into the agreement with the NEORSD.  The agreement shall continue for the duration of the NEORSD’s Regional Stormwater Management Program with the exception that the City may withdraw from the District’s Regional Stormwater Management Program as set forth in the previously executed Settlement Agreement between the City and District in 2012.

Staff recommends that Hudson City Council authorize the City Manager to enter into the Regional Stormwater Management Agreement with the Northeast Ohio Regional Sewer District.
