Legislative History
The Official Zoning Map was adopted with the Land Development Code in December 1999. This parcel has not been rezoned since then.
Purpose & Explanation
A private party has initiated a zoning map amendment to pursue a townhome development at a higher density than is permitted in the current zoning district. Townhomes are permitted in both Districts 1 and 3, but at a density of two units per acre in District 1 as opposed to five units per acre in District 3. Based on amending the zoning map alone the developer could build 41 units instead of 16 under the present zoning. Planning Commission conducted its preliminary review as required for private-party initiated zoning map amendments June 12. This request is associated with a request to amend the definition of "net density" in the Land Development Code. Both zoning map and text amendments are subject to six standards as discussed in the attached staff report.
Timing Considerations
Assuming Council refers the ordinance to Planning Commission July 18, Planning Commission will conduct its public hearing at the August 14 meeting. If Planning Commission renders its recommendation then, Council will conduct its public hearing in September and act on the ordinance in October.
