Executive Summary: This Ordinance will amend the Planning & Zoning Code (Land Development Code) to prohibit the cultivation, processing, dispensing, or sale of medical marijuana within the municipal limits of the City.

Ordinance No. 17-27; extending the moratorium for six months; passed February 7, 2017.
Ordinance No. 17-100; extending the moratorium until December 31, 2017; passed June 20, 2017.
Purpose & Explanation
Through Substitute House Bill No. 523, the 131st Ohio General Assembly and Governor John Kasich authorized the use of marijuana for medical purposes and established the medical marijuana control program. Substitute House Bill 523 also gave this Council the authority to adopt regulations prohibiting or limiting the number of medical marijuana cultivators, processors, and dispensaries within the limits of the City.
On June 20, 2017 Council conducted its first reading of this ordinance and referred it to Planning Commission for public hearing and recommendation. Planning Commission conducted its public hearing on August 14, 2017 and recommended that Council adopt the proposed ordinance as drafted.
Timing Considerations
Council's public hearing and second reading are scheduled for September 19, 2017. Council must take final action within twenty days of its public hearing which would require action by October 9, 2017.
