AN ORDINANCE ENACTING SECTION 1048.15, “DESIGNATION AND CONTROL OF MUNICIPAL ELECTRIC UTILITY FACILITIES” OF THE STREETS, UTILITIES, AND PUBLIC SERVICES CODE; AND DECLARING AN EMERGENCY.

Executive Summary:  This Ordinance will clarify designation of those poles and structures in the public right-of-ways in the City that are within the custody and control of Hudson Public Power which is necessitated by the deployment of small cell technology and facilities by the industry.

Purpose & Explanation

Pursuant to the passage of Ohio House Bill No. 478 regarding small cell facilities, this ordinance protects the City of Hudson from the installation of small cell technology equipment on to Hudson Public Power utility poles and/or structural assets within the public right-of-way.  The designation of such assets are as described in Ordinance 18-64, section 1048.15, paragraph (a).
