Executive Summary:  The legislation would replace the 2015 version specified in the Codified Ordinances with the most recent edition of the International Property Maintenance Code and amend the penalties.

Legislative History

The International Property Maintenance Code was adopted by Council in 2004 and 2015.

Purpose & Explanation

The legislation will keep Hudson’s standards in line with contemporary trade standards.  In staff’s opinion there will be no substantive changes to the current edition.

Currently, those found to be violating the Housing Code are subject to a municipal civil infraction or a minor misdemeanor.  City Staff desires to raise the aforementioned penalties for failing to comply with the City’s Housing Code to a third degree misdemeanor for first offenses and a first degree misdemeanor for subsequent offenses.  A third degree misdemeanor is punishable by a maximum fine of $500.00 and imprisonment for a maximum period of sixty days.  A first degree misdemeanor is punishable by a maximum fine of $1,000 and imprisonment for a maximum period of six months.
