Purpose & Explanation

Application has been received for a private party initiated amendment to the Planning and Zoning Code to create a new land use, “Senior Independent Living Community”, as a conditional use in District 8.  After the first reading and prior to a public hearing at Planning Commission, the city planning and legal staff continued to review the proposed project and the intended use with additional submittal from the applicant.  Staff determined the intended use was applicable to the current conditional use allowances for a Continuing Care Retirement Community (CCRC) within District 8.  The applicant submitted a conditional use request for a CCRC to the Planning Commission which was approved on December 11, 2017.  As the use have been approved, the applicant has requested to withdraw the proposed text amendment.     

Timing Considerations

With the second reading on January 9, 2017, City Council may take action to remove this Ordinance from further consideration, based on the applicant’s request to withdraw the proposed text amendment.

Staff recommends that Council pass a motion to remove the ordinance from further consideration, based on the applicant withdrawing his application for a Zoning Code text amendment.
