A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH THE SUMMIT COUNTY PUBLIC DEFENDER’S COMMISSION FOR DEFENSE OF INDIGENT DEFENDANTS IN THE STOW MUNICIPAL COURT.

Brief Description:   The City enters into an annual agreement with the Summit County Public Defender’s Commission for the defense of indigent defendants.  This Resolution authorizes such an agreement during the year 2021.

Legislative History

Pursuant to Chapter 120 of the Ohio Revised Code and Administrative Code 120-1-09, City Council annually authorizes the City Manager to enter into an agreement with the Summit County Public Defender’s Commission for the defense of indigent defendants.

Resolution No 19-177 authorized the 2020 agreement, passed December 3, 2019.

Purpose & Explanation

The City incurs costs for the defense of indigents in the Stow Municipal Court and is obligated to pay for the services provided, pursuant to Chapter 120 of the Ohio Revised Code and Administrative Code 120-1-09.  For invoices received year to date, 2 cases were billed at a rate of $170 per case, and a total of $340.00 has been paid to the Legal Defenders Office of Summit County during 2020.

The Legal Defenders Office has requested approval of legislation authorizing contract services for the defense of indigents for cases opened during the period from January 1 through December 31, 2021, billable at a rate of $170 per case or up to $750 if a case goes to trial, which reflects no increase over the current rates.  The proposed Agreement is attached as Exhibit A.   

Timing Considerations

This Resolution will be effective January 1 through December 31, 2021.
