Purpose & Explanation
When seeking professional design services, the City currently sends Requests for Proposals (RFPs) out to specific, qualified professional engineering and architectural consultants.

However, Chapter 153, "Public Improvements" of the Ohio Revised Code (ORC), indicates that Ohio public entities are required to publicly advertise and follow a qualifications-based selection (QBS) process when hiring an architect, engineer, or other design professional to perform professional (non-emergency) design services. Specifically, ORC 153.69, indicates that public authorities are required to evaluate statements of qualifications for professional design services, then rank the firms, and then negotiate a contract based on the ranking.

Legislation is needed to allow the City to forgo the process for locally funded projects, and in order to continue the professional design consultant selection via directly requesting RFP's, in addition to the public advertisement and QBS process.

An emergency clause is being requested to protect the safety and welfare of the public to meet on-going and upcoming professional design services proposals the City is working on and to process them as we have done in the past with a Request for Proposal schedules included in the request.
