Title

A RESOLUTION AMENDING RESOLUTION NO. 20-101 TO REFLECT CERTAIN CHANGES REQUESTED BY THE SUMMIT COUNTY DEPUTY FISCAL OFFICER; AND DECLARING AN EMERGENCY.

Brief Description:  This legislation will amend Resolution No. 20-101, a Resolution of Necessity previously adopted by this Council on September 15, 2020, to reflect certain changes requested by the Summit County Deputy Fiscal Officer.  The proposed amendments do not change the intent or purpose of the Resolution of Necessity for the renewal of the existing Library Levy.

Resolution No. 15-135, declaring it necessary to renew and increase by 0.6 mill an existing 2.3-mill tax levy for the purpose of supporting the free public library of the Hudson Library & Historical Society, and requesting the Summit County Deputy Fiscal Officer to certify the total current tax valuation of the city and the dollar amount of revenue that would be generated by that levy; passed September 1, 2015.

Resolution No. 15-141, submitting to the electors of the city the question of the renewal and increase by 0.6 mill of an existing 2.3 mill tax levy for the purpose of supporting the free public library of the Hudson Library and Historical Society; passed October 20, 2015.

Ballot Issue #4, approving a renewal and increase of the existing Library Levy; passed by voters on March 15, 2016.

Purpose & Explanation

In response to the Hudson Library & Historical Society ’s request for placement of an Issue on the May 4, 2021, ballot for renewal of the existing 2.9-mill tax levy, City Council passed Resolution No. 20-101 on September 15, 2020.  This Resolution is needed to amend Section 1 of Resolution No. 20-101 to reflect certain changes, as requested by the Summit County Deputy Fiscal Officer as follows:

 

Section 1.  This Council declares it is necessary to renew, for five years, all of an existing 2.9-mill ad valorem tax outside of the ten-mill limitation to be levied upon the entire territory of the City of Hudson, which is located entirely within the County of Summit, for the purpose of supporting the free public library of the Hudson Library and Historical Society, and that it intends to submit the question of that renewal and increase tax levy in the form of a ballot measure, with said taxes to be first levied in the year 2021 and first collected in the year 2022, to the electors within the entire territory of the City of Hudson at an election on May 45, 2021, as authorized by Section 5705.19 and 5705.191 and pursuant to Section 5705.03 of the Ohio Revised Code.”

Legal Authority for Proposed Legislation

The Library Board does not have legal authority to place a levy on the ballot and has requested City Council do so on its behalf.

Fiscal Impact

No direct fiscal impact on the City. The City acts as a conduit for the levy proceeds.

Does this legislation require use of an emergency clause?

  X                         Yes, emergency language is included with the current legislation, so that Council can timely proceed with a subsequent Resolution to place an Issue on the May 4, 2021 Ballot to renew the current Library Levy (see above proposed schedule).

Suggested Action

Pursuant to the Library’s request for placement of an Issue on the May 4, 2021, ballot for renewal of the existing 2.9-mill tax levy, staff recommends passage of this Resolution to amend Resolution No. 20-101, a Resolution of Necessity previously passed by Council, to reflect certain changes requested by the Summit County Deputy Fiscal Officer.
