Executive Summary
This legislation will retain Arcadis for the subject project in the base amount of $137,800 plus $13,780 contingency, totaling $151,580.  The anticipated improvements which include standard lane widths, bike lanes, curb, walks, upgraded signal and traffic control will improve the health and safety of the community at this intersection.

Purpose & Explanation
This project will replace the temporary signal and improve the pavement and pedestrian access at the Prospect and SR 91 intersection.  This signal is the result of the recommendations of the traffic impact study done for the Downtown 1st & Main Redevelopment Project.  Two studies of this intersection indicated that turn lanes are not warranted. The project includes improved lanes widths on SR 91 and Prospect Street, bike lanes, curb, sidewalks, storm sewer, streetlights, striping and signage.  The GPD's construction estimate for the project is approximately $600,000.
A request for proposal for this project of the design was publicly advertised and we had six engineering design firms submit technical qualifications.  After evaluation of the qualifications, GPD group was selected to submit a fee proposal.  This process is the approved method of consultant selection by the Ohio Department of Transportation (ODOT).  ODOT is the administrator of the federal funds being utilized for the construction of this project.  GPD Group's negotiated fee was $ 153,600 without contingency.  Council, at the May 22, 2012 workshop meeting, directed City staff to investigate a fee from the second most qualified firm.  The 2nd firm was Arcadis and their negotiated fee is $137,800.  After a careful review of the proposals we recommend Arcadis for the design of this project.
As with other professional services contracts we are requesting a 10% contingency to handle any minor changes in the scope of services that occur during the course of the design.  For this contract the 10% amount would be $13,780.  For large considerations we would return to the City Council for any additional funds necessary to correct or adjust the situation.
Timing Considerations
The design will begin once the contract is approved by City Council.  The anticipated schedule for the completion of the construction of the improvements is the Fall of 2013/Spring of 2014.

Suggested Action
Recommendation
The City staff recommends that City Council approve the recommended resolution authorizing the City Manager to enter into a contract with Arcadis for the design of the SR 91/Prospect Street Intersection Improvement Project.  The total amount including the contingency would be $151,580.  City staff is also requesting that an emergency clause be added to the legislation in order to protect the public welfare and safety.
