A RESOLUTION AMENDING RESOLUTION NO. 20-12 TO AUTHORIZE THE CITY MANAGER TO ENTER INTO A CONTRACT WITH LIBERTA CONSTRUCTION FOR THE STATE ROUTE 91 NORTH TURN LANE IMPROVEMENT PROJECT (PID 93822); AND DECLARING AN EMERGENCY.
Brief Description: The project will include the addition of left turn lanes at Valley View Road, Herrick Park Drive & Hines Hill Road, resurfacing of SR 91 from Brandywine Drive to Middleton Road, the installation of an 8’ sidewalk on the east side of the road, and bike lanes on both sides of the road from Brandywine Drive to Middleton Road. Project bids were received and were in excess of the amount previously approved.

Purpose & Explanation
The project will include the addition of left turn lanes at Valley View Road, Herrick Park Drive & Hines Hill Road, resurfacing of SR 91 from Brandywine Drive to Middleton Road, the installation of a sidewalk on the east side of the road, and bike lanes on both sides of the road from Brandywine Drive to Middleton Road.
Project bids were received on May 12, 2020 and the low bid received for the construction of the project is $5,765,572.21 which is within 10% of the engineer’s estimate, but in excess of the amount authorized. The total project cost is $5,765,572.21 plus 5% contingency is $6,053,850.82 ($5,765,572.21 + $288,278.61 contingency)

ODOT Funding = $3,025,000
Akron Funding = $681,495.15
City of Hudson Cost = $2,347,355.67
The final engineer’s estimate at the time of bidding was $5,394,202.18
Evaluation of Bids & Cost Increase
Prior to bidding, additional items (“Missed by the Consulting Engineer”) were added that were identified by the Owner’s Representatives. These included additional material needed to maintain traffic, bid description and quantity changes, and added bid items required by Akron and ODOT.
After the May 12 bid opening, a review of the contractors bid items revealed that the pavement, sidewalk, tree clearing/grubbing and restoration items came in over the engineer’s estimate contributing to the cost increase. Staff contacted the lowest and best contractor who indicated that the overall cost increases between the estimate and bid costs to pavement and sidewalk items could partially be associated with recent labor and stone material increases. The contractor indicated that the costs associated with topsoil and restoration are their normal costs for the purchase, hauling and spreading of topsoil to meet the City’s standards. The increased cost with clearing/grubbing was due to the contractor ‘front loading’ (profit) this item to account for bonding, insurance, additional work and project unknowns.
The contract is required to be awarded by June 15, 2020 due to the ODOT/FHWA’s fiscal schedule. Construction would begin in July 2020. The construction duration will be approximately 12-15 months.
