Purpose & Explanation

This project includes a multi-use path between Veterans Way Park and Barlow Road.  The project design scope includes environmental impact analysis, path design including: potential pedestrian bridges, fencing, retaining walls, asphalt trail, sediment control, governmental agency coordination (US Army Corps of Engineers & OEPA, etc.), private agency coordination (other agencies), elevated decking as needed, drainage improvements, clearing, grading, public comment/input.  Proposed length of improvement is approximately 9,000’ from the intersection of Veterans Way and Milford Drive to Barlow Road at the southwest corner of the Ellsworth Meadows Golf Course. No right-of-way plans nor acquisition is anticipated as all work is to be performed within existing right-of-way or other public property.  The current concept includes:

 

• Milford Drive from Veterans Way to E. Case Drive: Sidewalk widening and associated improvements behind curb on the south side of Milford Drive. Widening shall be within existing available open space, as no right-of-way nor retaining walls are proposed. No structures nor drainage improvements are proposed.

 

• E. Case Drive from Milford Drive to Lynn Drive: Signing and pavement markings only. No sidewalk, structures, or drainage work is proposed.

• Cascade Park segment: Full trail design and plan preparation, including drainage design.  Structures as needed.

 

• Ellsworth Meadows segment: Full trail design and plan preparation, including drainage design. Structures as needed.

This project will tie into the Barlow Road path.  The City is funding the design, however, the City is receiving federal Transportation Alternative Program funding ($500,000) for the construction of this project.  The MB's construction estimate for the project is approximately $1.1 million to $1.2 million.

 

A request for proposal for this project of the design was publicly advertised and we had six engineering design firms submit technical qualifications. After evaluation of the qualifications, B&N was selected to submit a fee proposal. This process is the approved method of consultant selection by the Ohio Department of Transportation (ODOT). ODOT is the administrator of the federal funds being utilized for the construction of this project. B&N's negotiated fee was $ 270,442 (IA $77,775) without contingency. City staff decided to investigate a fee from the second most qualified firm. The 2nd firm was MB and their negotiated fee is $231,581 (IA $62,131).  After a careful review of the proposals we recommend MB for the design of this project.

 

As with other professional services contracts we are requesting an 8.5% contingency to handle any minor changes in the scope of services that occur during the course of the design. For this contract the 8.5% amount would be $18,419. For large considerations we would return to the City Council for any additional funds necessary to correct or adjust the situation.

Timing Considerations

Once Council approval, staff will enter into a contract with Michael Baker International.

Staff recommends that Council approve the recommended resolution authorizing the City Manager to enter into a contract with Michael Baker International for the design of Veterans Trail Phase 3.  City staff is also requesting an emergency clause to be added to the legislation in order to stay within ODOT deadlines.
